For the second time this year, a Lima man charged with taking another person's life has been released from jail.
19 year old Deshawn Porter is a free man today.
An Allen County Grand Jury heard evidence this week related to the deadly shooting of Isaiah Smith of Columbus on May 20th.
The Grand Jury decided not to return an indictment against Porter.
Allen County Prosecutor Juergen Waldick says this incident may have been viewed as a case of self-defense.
Waldick says the case is still under investigation and can be re-filed if any new evidence surfaces.
Lima police say the shooting in the 1300 block of West High Street occurred when Porter and Santario Simpson met Smith to sell him marijuana.
They believe Smith pulled a gun on Porter and Simpson, a struggle ensued, Simpson was shot in the leg. Porter got ahold of a gun and Smith was shot in the head and killed.
The Allen County Sheriff's Office say Porter has been released from jail.
