The psychologist who performed the mental evaluation on the Shawnee man accused of murdering his brother won't be part of his murder trial.
During a hearing today Judge Richard Warren ruled James Ream's defense attorneys cannot call Dr. Matthew Ziccardi to testify during Ream's trial.
Ream allegedly shot his brother Ronald Ream, 62, then turned himself into authorities the next day.
Ream originally pleaded not guilty by reason of insanity but withdrew that plea for not guilty after he was found competent to stand trial.
Ream's lawyer said Dr. Ziccardi's evaluation proved Ream wasn't trying to avoid arrest and explains ream's erratic behavior after the murder. Prosecutors argued the evaluation does not address whether Ream's shot is brother in self-defense, which is what Reams and his attorney claim. Judge Warren agreed, ruling Ziccardi cannot testify for the defense.
