The investigation is now complete and Mercer County Sheriff Jeff Grey says Officer Andy Regedanz was justified in firing his gun as he had a split second decision to protect himself and the public.
On April 10 a concerned citizen had twice called 9-1-1 to report a man was walking down the street shirtless in shorts and a cowboy hat while twirling a gun.
That man was 39 year old Robert Hensley.
When Officer Regedanz arrived on scene, he ordered Hensely to show his hands, but he didn't comply with the officer's request.
Two rounds had been fired from Hensley's gun but not during the officer encounter. The remaining four chambers were also empty, but it is still unknown as to what caused this strange behavior.
Sheriff Grey says Hensley's family reported that he had been having difficulty lately and was even hearing voices.
After nine days of investigation and 33 interviews, 5 of which were eye-witnesses, the investigation has been turned over to the prosecutor's office.
