The Lima Police Department says that Sergeant David Gillespie will be cleared to return to duty effective monday.
The Allen County Prosecutors office reviewed the investigation into the March 27th incident where Sergeant Gillespie was drawn out side of the Lima Police Department and was stabbed in the head with a screw driver by 41 year old John Heffner.
Gillespie shot Heffner twice. Both men have been treated and released from the hospital. Gillespie was placed on paid administrative leave pending the results of the criminal and internal investigation.
Prosecutors say that Gillespie acted in self defense and the internal Lima Police Department investigations says the 18 year veteran didn't violate department policy.
Heffner had being charged with felonious assault with a deadly weapon and could be facing additional charges after his case is reviewed by the Allen County Grand Jury.
Heffner remains at the Allen County Jail with bond set at $500,000.
