Ernest Kaylor is naming the Allen County Jail responsible for his contraction of MRSA while incarcerated in August of 2015. The lawsuit was filed in federal court in Toledo on July 17th. It claims that defendants employed by the county's correctional facility at the time of the incident knowingly permitted MRSA infected inmates to come in contact with non-infected inmates and failed to properly sanitize bedding, clothing, and common areas.

The lawsuit also states despite having knowledge of other MRSA infected inmates the Allen County Jail refused Kaylor's request to be tested, insisting the spot on his skin was just an insect bite. During a 6 day period Kaylor's sore became worse causing symptoms like sweats, chills, and nausea.

As of July 17th, Allen County Sheriff, Matt Treglia says they have not been served with the lawsuit. MRSA is a form of staph bacteria that is resistant to several antibiotics and is prone to spread in densely populated conditions.
