A former high school band director appeared in Hardin County Common Pleas Court Tuesday morning to try and have his case thrown out because of the first amendment.

Judge Scott Barrett is still making a decision on whether or not to throw out the case, which surrounds 70 year-old Dennis Dellifield, who is facing multiple counts of attempted pandering obscenity involving a minor,  and attempted illegal use of a minor in nudity oriented material and performance.

The jury trial date for this case has been set for January.
