The lawyer for a 19-year-old who allegedly made threats to shoot up Elida School on September 1st is trying to get evidence removed before trial.

Judge David Cheney pushed back a suppression hearing scheduled for today for Tristan Ascura so an interpreter can be brought in for one of the witnesses at that hearing. Ascura's attorney, Bill Kluge, has filed motion that the rifle and ammunition collected from Ascura's home not be allowed as evidence during the trial. Ascura's Filipino uncle owns the home and Kluge contends that since he doesn't speak English, he didn't fully understand what was going on when sheriff's deputies came to the home and seized the rifle and the ammunition. Kluge is also looking to have statements with law enforcement suppressed and he is waiting on records from the Elida School District that might contradict those statements.  

Ascura is set to go to trial on December 3, 2018.
