The Lima man charged with 52 counts revolving around sex crimes was back in court on Thursday for a motion hearing.
39-year-old Jay Holliday and his counsel filed two motions, one to dismiss 16 counts of unlawful sexual contact with a minor and a second motion to split the case into two because there are two alleged victims. The defense believes the state won't be able to prove the age of the victim when the alleged crimes happened and they believe a jury may be confused between the two alleged victims. The state disagrees and said evidence between both victims is admissible.
Judge Terri Kohlrieser says she needs more facts and will await written argument over the next two weeks before making any rulings.
