A Logan County case is at the heart of an upcoming hearing in the Ohio Supreme Court to determine if there is a statute of limitations to charge someone with attempted murder. Last year, Ralph Bortree was found guilty of by a Logan County jury of attempted aggravated murder in a 1993 cold case. In 2019, DNA evidence linked Bortree to the 26 year old case, where a Logan county woman was raped, had her throat slashed and was left for dead in a rural part of the county. The Ohio Supreme Court has agreed to consider how long prosecutors have to charge someone with attempted murder or attempted aggravated murder. Attorneys for Bortree argue that that crime's statute of limitations ends after six years. Prosecutors say there's no time limit on prosecuting a murder or attempted murder-related crime. Bortree was sentenced to 11 years. It is unknown when the Ohio Supreme Court will hear the arguments.
