The videotape from an assault last year was the focus of a motion hearing this morning in Allen County Common Pleas Court.
33-year-old Justin Shears' attorney, Greg Donohue made the motion to get more information about the surveillance video from Marko's Bar from the night of September 20, 2017. That night according to witnesses, Shears allegedly pistol-whipped a man, who fell to the ground, and then he attempted to take items off of the victim. Shears then allegedly made threats to the victim trying to rob him. Shears questions any videotape that the police collected from the bar, saying he believes it is edited. The hearing was continued so the officer that collected the video can be questioned.
Prosecutors did offer Shears a deal for a guilty plea to aggravated robbery with a firearm specification and felonious assault charges, and another gun specification and weapons under disability charge would be dropped. Shears rejected the deal, and he is currently scheduled to go trial next month.
