The former Lima doctor who was sentenced to life in prison for killing his wife, is appealing the conviction in federal court.
Former anesthesiologist, Mark Wangler is serving a life sentence for the aggravated murder of his wife Kathy. He was convicted during a 2011 trial. However, Kathy Wangler died in 2006 from carbon monoxide poisoning.
According to the appeal, Wangler says the trial court erred by allowing evidence obtained by an unconstitutional use of a search warrant. The evidence in question includes diary entries written by Wangler. Other points of contention include allowing expert testimony from the state, but not allowing expert testimony presented by the defense.
Wangler will be eligible for parole after serving 25 years of his sentence. He is currently housed at the Toledo Correctional Institution.
