A Lima man who was found guilty of killing his girlfriend’s son, will not get his appeal heard by the Ohio Supreme Court.
A judge decided a mother who played a part in her infant son's death has served enough time in jail. Shelly Wireman was sentenced to four years of community for two counts of endangering children. Wireman has served close to two years in jail since her arrest in 2018. Wireman's boyfriend at the time, Gabriel Salyers, was convicted for the death of her son Jaxxon Sullivan. A trial revealed Salyers shook the boy to get him to sleep. Wireman agreed with the prosecutor that her drug addiction contributed to her negligence of how Salyers treated the child. He was hurt at least two times before he was killed.
A Lima mother facing charges related to her child's death has agreed to a plea deal.
On Tuesday, after a six day trial, Gabriel Salyers was sentenced to 31 years to life, nearly a year to the day 18 month old Jaxxon Sullivan was murdered. "We think that’s appropriate for the conduct," Allen County Prosecutor Juregen Waldick said. "He showed absolutely no remorse and he should not be in a position to harm another trial ever."
Monday brought about the fifth day of the trial against Gabriel Salyers. On that day, the 32-year-old accused of murdering an infant took the stand. During examination, Salyers testified in chronological order the week leading up to the death of 18 month old Jaxxon Sullivan. Shelly Wireman, the boy’s mother, also was called to testify Monday, but chose to invoke her fifth amendment rights.
The prosecution came to rest on the fourth day of the trial for Gabriel Salyers. The state called to the stand the lead detective in the case, Sean Niemeyer, as well as Lucas County Coroner, Dr. Diane Scala-Barnett, who performed the autopsy of infant Jaxxon Sullivan. The jury saw visuals such as an interview with Sullivan's mother, Shelly Wireman, who told police her and Salyers had been using suboxone.
The case against 32-year-old Gabriel Salyers resumed Wednesday morning. The state bears the burden to prove Salyers committed the crimes and began calling witnesses. After two Lima Police Department officers testified, Detective Brian Snyder took the stand and his two-hour interrogation was played for the jury.

Judge Jeffrey Reed granted a motion to exclude any reference of any civil lawsuits the defendant is involved in, should the case go to trial.
