The resignation is official and the man that once lead the Shelby County Sheriff's office will spend two years on community control.
Former Shelby County Sheriff Dean Kimpel will not be spending any time behind bars as he is sentenced on a 5th degree felony for unauthorized use of the Ohio Law Enforcement Gateway
Miami County visiting Judge Robert Lindeman sentenced Kimpel to 2 years of community control, a thousand dollar fine and court costs.
As long as Kimpel does not break any of the agreed special conditions to the plea agreement, including "no" law enforcement jobs during the two year period he will not be incarcerated.
The former sheriff did not comment during his sentencing Friday but his attorney Michael Rumer did speak on his behalf before sentencing stating that Kimpel did not realize that he had broken the law when using the law enforcement gateway to run a check on a former Auglaize county deputy and that they are pleased with the judges ruling.
Kimpel had original been indicted on 5 counts but a plea agreement dropped it to 1 count.
A charge of sexual battery involving a former female deputy, a felony of the 3rd degree, previously filed in Auglaize county was officially dismissed Friday as well as part of the plea agreement.
