Ohio facing lawsuit over wind turbine legislation

Some Paulding County residents are suing the State of Ohio because energy companies have stopped future wind energy projects after lawmakers changed regulations for turbine placement.

According to the civil suit filed in the Paulding County Clerk of Courts Office on Tuesday, three landowners and the Mid-Atlantic Renewable Energy Coalition, which is made up green energy companies in this part of the United States, are suing Ohio saying the new regulations passed to increase the setback for wind turbines was unconstitutional. The lawsuit contends that since the change in regulations were part of the bill for the Ohio budget, and has nothing to do with funding it, that violates the single subject rule in the Ohio Constitution. If they win this ruling, they would like to see the regulations revert back to what they were before the change.

Recently, Apex Clean Energy dropped out of a wind turbine project in Van Wert and Mercer County, citing the reason of state policies.Â
