Brooks in Custody Dispute

A Findlay man serving time for obstruction in the Vera Jo Reigle murder case continues his fight for custody of their two year old daughter.

Zachary Brooks is appealing a decision to place his daughter with Children's Protective Services. Brooks' attorney did not appear in 3rd District Appeals Court Tuesday but argued in a written statement "the daughter would have stability and comfort with her biological family."

Hancock County Prosecutor Mark Miller says that it is in the child's best interest to be placed up for adoption, have her name changed, and be relocated.

Brooks is serving a four year sentence and is not guaranteed early release. Miller says Brooks has not enrolled in drug rehab or parenting classes. There have been two scheduled meetings between Brooks and his daughter. Miller says the child showed fear of her father in one meeting and Brooks failed to show for the other. The child is currently in the care of foster parents who have plans on adopting.

No word yet on when the appeals court will make its ruling.
