KENTON, Ohio (WLIO) — A Kenton man will receive a new trial after being sentenced to 20 years in prison for sex-related charges last summer.  Brian Richardson, 53, appealed his plea deal and sentence on three counts of sexual battery and one count of gross sexual imposition.

During the change of plea hearing, the Hardin Co. judge did not orally inform Richardson that he would be waiving his rights against self-incrimination at trial, and that he would be able to use subpoena power to compel witnesses to testify on his behalf.

Ohio’s Third District Court of Appeals has sent the case back to Hardin County, where Richardson is now facing his original indictment, which includes 28 counts of rape, two counts of kidnapping, and three counts each of sexual battery and gross sexual imposition.

A jury trial has been scheduled for October, and the judge has set his bond at $250,000.
