Nature of Complaint:  Sexual conduct while on duty, Code of Ethics

 On Tuesday 07/26/11 I received a call from the Ohio State Hwy Patrol that during a background investigation that they were conducting had learned that one of our officers may have been involved in a sexual liaison on duty during his lunch break.  I inquired about the name of our officer and they advised they would get back with me after checking with superiors.  They did re-contact me and I learned that our officer was Sgt. Larry Curl.

 I then started making inquiries into Sgt. Curl's work and contacts.

 On 08/03/11 Sgt. Curl came into my office and requested to speak with me.  Sgt. Curl advised that he had heard that the Ohio State Hwy Patrol had contacted me and wanted to admit to the violation.  Sgt. Curl advised that it had occurred sometime in June and he was sorry.  I inquired as to the circumstances and he advised that he had met up with her and then went back to his residence where they engaged in sexual intercourse, during his break.  I inquired if this was the only occurrence and he assured me it was. 

 We discussed the responsibility of a supervisor leading by example and the possibility of the other officer needing assistance while working 3rd shift.  (Sgt. Curl was assigned to work 0000/0800 hrs.)  Sgt. Curl advised he understood and was very apologetic.  I advised Sgt. Curl of the position he had placed our citizens, other employees, our department and himself in.  I advised that I will attempt to gather further information before I make any decision.

 After learning that Sgt. Curl had been spending a lot of time on the telephone while on duty, I did subpoena phone records. I also conferred with the Allen County Prosecutors Office; reference any possible criminal offenses.  The prosecutor's office believed it was an internal matter. I then reviewed Sgt. Curl's assignments for the past few months.  The phone records took over two months to receive. I discovered Sgt. Curl may have committed other Policy violations and had neglected some property room assignments.    

 I placed Sgt. Curl on administrative leave on 08/23/11.  Prior to Sgt. Curl's scheduled interview, Sgt. Curl resigned his position effective 11/07/11.  The investigation will be placed into inactive status. Follow up interviewing with Sgt. Curl related to the other possible violations, will not occur.
